1-Information We Collect

The categories of personal information we collect about you depend on how you interact with us. We may collect the following categories:

Identifiers and Contact Information

Name, postal address, email address, telephone number, date of birth, account username, order number, loyalty program member ID, and other similar identifiers.

Commercial Information

Records of products or services purchased, considered, or returned; purchasing or consuming histories or tendencies; Wishlist’s; and in-store interactions with our beauty advisors.

Payment and Transactional Information

Billing address and transaction details for orders you place. We use third-party payment processors to handle payments and we do not store full payment card numbers on our own servers.

User-Provided Content

This refers to any material or information you choose to share with us, including your direct communications, social media details, community participation, photos, videos, images, survey answers, feedback, reviews, testimonials, and any other submissions you make.

Internet and Other Electronic Network Activity Information

Information about your interaction with our Sites, our Communications, and our advertisements, including IP address, device and browser type, operating system, unique device identifiers, mobile advertising identifiers, cookie and pixel identifiers, referring and exit URLs, pages viewed, time and duration of visits, scroll depth, clicks, mouse movements, search queries, and similar usage and diagnostic data. We may gather this data using various tools, such as session replay technologies, third-party tracking pixels, and similar monitoring methods. The information collected may also be shared with the providers of these tracking tools.

Geolocation Information

Approximate (non-precise) location derived from your IP address or the billing/shipping address you provide. If you enable precise geolocation on your device, we may use that information to help you find nearby Stores; you can disable this at any time in your device settings.

Audio, Electronic, and Visual Information

Voice recordings when you contact our customer service team (for quality assurance and training, where permitted by law) and images or security camera footage captured at our Stores.

Inferences

Inferences drawn from the information above, such as preferences, interests, and predicted product interests, used to personalize offers and communications.

Communications and User Content

Information you provide when you contact us, participate in surveys, submit reviews or testimonials, engage on social media, enter promotions, or otherwise communicate with us.

Sensitive Personal Information

We do not intentionally collect sensitive personal information as defined by the California Privacy Rights Act ("CPRA"), such as Social Security numbers, driver's license numbers, precise geolocation, racial or ethnic origin, religious beliefs, genetic data, or biometric identifiers for the purpose of uniquely identifying you. If we inadvertently receive such information, we will handle it in accordance with applicable law and will not use it to infer characteristics about you.

2-How We Collect Information

Directly From You

We collect information you provide when you create an account, join the Rewards Club, place an order, sign up for emails or text messages, contact customer service, visit our Stores, complete a form, post a review, or otherwise interact with us.

Automatically From Your Device

When you use our Sites or open our emails, we and our third-party partners automatically collect certain information through cookies, pixels, tags, software development kits, web beacons, and similar technologies. See Section 3 for details.

From Third Parties

We may receive information about you from:

·       Service providers who help us operate our Sites, Stores, and Services (such as payment processors, shipping carriers, marketing analytics platforms, and fraud prevention vendors).

·       Advertising and analytics partners who help us measure and improve our marketing.

·       Social media platforms when you interact with our content or log in using a third-party account.

·       Data enrichment vendors, in accordance with applicable law; and

·       Publicly available sources.

3-Cookies, Pixels, and Other Tracking Technologies

We and our third-party partners use cookies, pixels, tags, web beacons, software development kits ("SDKs"), and similar technologies on our Sites and in our Communications. These technologies allow us to recognize your browser or device, remember your preferences, understand how users engage with our Sites, measure the performance of our marketing, deliver and personalize advertising, and detect fraud and security threats.

 

Types of Technologies We Use

Cookies. Small text files stored by your browser. Session cookies are deleted when you close your browser; persistent cookies remain until they expire or you delete them. First-party cookies are set by Planet Beauty; third-party cookies are set by other companies whose technology appears on our Sites.

Pixels and Web Beacons. Small pieces of code or invisible images embedded in web pages or emails that send information to a server when loaded. Pixels are commonly used for analytics, advertising attribution, and retargeting.

Tags and SDKs. JavaScript tags and mobile software development kits that enable analytics, measurement, and advertising functionality.

Local Storage and Similar Technologies. Browser-based storage mechanisms (such as HTML5 local storage) used for similar purposes as cookies.

Application Technologies: These are tools used within our mobile apps and Sites that operate outside of browser-based controls, such as cookies, and therefore cannot be managed through browser settings. For instance, our Sites may use software development kits (SDKs)—code that transmits information about your activity to a server. These technologies help us monitor communications, deliver advertising both on and off our Sites, and enable features like linking your account with social media platforms.

Third-Party Analytics Services: We collaborate with external companies and analytics tools, including those identified below, to evaluate how users engage with our Sites and to better understand usage patterns, trends, and interest in our Products. Strictly Necessary. Required for the Sites to function, including shopping cart, checkout, authentication, and fraud prevention. These cannot be turned off.

Our Sites recognize and honor the Global Privacy Control browser signal as a valid opt-out of the "sale" and "sharing" of personal information for California residents and as an opt-out of targeted advertising for residents of other states that recognize such signals. ·       Browser Controls. Most browsers allow you to refuse or delete cookies through settings. Note that disabling cookies may affect the functionality of the Sites.

·       Industry Opt-Outs. You may opt out of interest-based advertising from participating companies through the Digital Advertising Alliance (www.aboutads.info/choices), the Network Advertising Initiative (www.networkadvertising.org/choices), and the European Interactive Digital Advertising Alliance (www.youronlinechoices.eu).

·       Mobile Device Controls. On mobile devices you can reset or limit ad tracking through your device settings (Limit Ad Tracking on iOS; Opt Out of Ads Personalization on Android).

 

"Do Not Track" Signals

Because there is no common industry or legal standard for recognizing "Do Not Track" signals, our Sites do not respond to "Do Not Track" signals. We do honor the Global Privacy Control signal as described above.

4-How We Use Your Information

We use personal information for the following business and commercial purposes:

We may disclose your personal information to help provide our Services to you.  For instance, we may disclose your information to our service providers to respond to your requests or to provide customer service. We may also provide your personal information to service providers who assist us in providing certain services.  For example, we may provide the information we collect from you with our cloud hosting service providers, or our payment card processing providers. We may also disclose your information to our affiliates.

We may also disclose your information for the following purposes:

Service Providers. With vendors and service providers that perform services on our behalf, such as website hosting, ecommerce platform services, payment processing, shipping and logistics, customer service, email and SMS delivery, marketing analytics, advertising measurement, fraud prevention, and data security. We require service providers to use personal information only to provide services to us and not for their own independent purposes.

Advertising and Analytics Partners. With the advertising and analytics partners identified in Section 3 for analytics, attribution, retargeting, and the delivery of relevant advertising, which may constitute a "sale" or "sharing" of personal information under California law. You can opt out as described in Sections 3 and 9.

Affiliates. With our corporate affiliates for purposes consistent with this Privacy Policy.

Legal and Safety. When we have a good-faith belief that disclosure is necessary to comply with applicable law, legal process, or a lawful government request; to enforce our terms; to protect the safety, rights, or property of Planet Beauty, our customers, or others; or to investigate fraud or security incidents.

Business Transfers. In connection with a merger, acquisition, reorganization, financing, sale of assets, bankruptcy, or similar transaction, your information may be transferred as part of the transaction.

With Your Consent. When you direct us to share your information or otherwise consent to the disclosure.

6-Categories of Personal Information Sold or Shared

Under California law, the term "sell" includes disclosing personal information to a third party for monetary or other valuable consideration, and the term "share" includes disclosing personal information for cross-context behavioral advertising. Our use of certain advertising and analytics technologies described in Section 3 may constitute a "sale" or "sharing" of personal information under California law, even when no money changes hands.

We do not knowingly "sell" or "share" the personal information of consumers under 16 years of age. We do not "sell" or "share" sensitive personal information for purposes other than those permitted without the right to limit under California law.

7-How Your Information Is Stored, Secured, and Retained

Security

Planet Beauty takes the security of your information seriously and uses reasonable administrative, physical, and technical safeguards to protect it. However, no system or website can be completely secure, and we cannot guarantee the absolute security of your data. We also cannot control your device or network, which may be vulnerable during transmission over the internet.

Retention

We retain your personal information for as long as it is needed to deliver our Services and to meet legal and regulatory requirements, resolve disputes, and enforce our policies. Retention periods depend on the nature of the information and the purposes for which it was collected. In accordance with applicable laws and regulations, we may also be required to maintain records that include client personal information, account opening documentation, communications, and other relevant materials. We do not keep personal or sensitive personal information for longer than is reasonably necessary for its intended purpose.

We may also update, correct, or delete incomplete or inaccurate information at any time, at our sole discretion.

International Transfers

Our operations are primarily in the United States. If you access the Sites from outside the United States, your information will be transferred to, stored, and processed in the United States, which may have data protection laws different from those of your country.

Marketing Communications

You can opt out of marketing emails by clicking the "unsubscribe" link in any marketing email.

You can opt out marketing text messages by replying STOP to any marketing message (message and data rates may apply). You may continue to receive transactional or service-related communications (for example, order confirmations) after opting out of marketing.

Account and Profile

You can access and update information in your Planet Beauty account at any time by logging in.

9-California Privacy Rights

Your Rights Under California Law

If you are a California resident, you have the following rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, "CCPA"):

·       Right to Know / Access. Request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the purposes for collection, and the categories of third parties with whom we share the information.

·       Right to Delete. Request that we delete personal information we have collected from you, subject to certain exceptions.

·       Right to Correct. Request that we correct inaccurate personal information we maintain about you.

·       Right to Opt Out of "Sale" or "Sharing." Direct us not to "sell" or "share" your personal information, including for cross-context behavioral advertising.

·       Right to Limit Use of Sensitive Personal Information. We do not use sensitive personal information for purposes that would require offering this right.

·       Right to Non-Discrimination. You will not receive discriminatory treatment for exercising your privacy rights.

·       Right to Data Portability. Receive a copy of the personal information you have provided to us in a portable format.

How to Exercise Your Rights

We will verify your identity before fulfilling a request to know, delete, correct, or port your information. Verification may require us to match information you submit against information we already maintain. We will respond within the timeframes required by law.

Authorized Agents

You may designate an authorized agent to submit a request on your behalf.

We will require written authorization and may contact you to verify the request, except for opt-out requests accompanied by valid proof of agent authority.

Appeals

If we deny your request, you may appeal our decision by replying to our denial message or by contacting us using the methods in Section 15.

California "Shine the Light" Law

California Civil Code § 1798.83 permits California residents to request information about our disclosure of certain personal information to third parties for their direct marketing purposes. To make such a request, email info@planetbeauty.com with the subject line "Shine the Light Request."

Notice at Collection

This Privacy Policy, together with any just-in-time notices provided at the point of collection, serves as our Notice at Collection for California residents. Residents of Other States
